Why is this happening?
The appeal system is currently under extreme pressure.
As of November 2025, there were nearly 49,000 student visa appeals waiting to be decided, more than double the number from the year before. Each month, thousands of new appeals are lodged, far exceeding the tribunal’s capacity to finalise cases.
This means student visa appeals are taking a median time of one year and four months to run through the system – up from a less-than-11-month wait time at the end of 2024. By doing so the government hopes to resolve the issue with the long waiting period for the ART outcome.
